Livestock Carriers Exemption 

The “ Heavy Vehicle Driver Fatigue National Model Legislation” document (120 pages) needed to be analysed prior to it going to Cabinet on 11th August 2008.  With the help of T.E.A.M. (Transport Engineering and Management) and LTASA Committee Members, LTASA produced a document that was presented to Minister Conlon at a meeting on 7.8.08.  The document was titled DRIVING HOURS VERSUS WELFARE OF FARM ANIMALS UNDER THE NEW HEAVY VEHICLE DRIVER FATIGUE LAWS IN SOUTH AUSTRALIA.  To view a copy of this document please click on the link below.   D. Smith, B McArdle & R. Quinn attended the meeting Minister Conlon on 7.8.08.  LTASA advised the Minister:
• We support the new fatigue laws – safety is not to be compromised
• We believe we have issues with fatigue regarding animal welfare
• LTASA propose we keep existing exemption in place for Livestock Carriers – for animal welfare (as the new laws did not include this exemption).
• Law enforcement – need to develop a code of practice for all parties concerned.
Minister Conlon agreed that the Current 2002 exemption should be extended for a further 3 years in both Standard and Basic Fatigue Management legislation.

This discussion was further confirmed to D Smith from Pat Gerace from the Ministers Office. 
• P Gerace confirmed our discussions with the Minister
• Has made contact with Heavy Vehicle Driver Fatigue Unit
• The current exemption will remain valid for up to three years or until altered. Or can be adapted into the new fatigue laws.
• LTASA will have the opportunity to have input into any alteration
• Copy of the exemption must be carried in the vehicle (please refer to link below for a copy of the Exemption)
• Anytime that the exemption is used, it must be noted in the work diary with the reason why.
